Court backs Puerto del Rosario's 2025 OPE

Municipal Government Wins Ruling Against Intersindical Canaria

The Puerto del Rosario City Council announced that it has received a new definitive judgment in its favour regarding the 2025 Public Employment Offer (OPE), after the administrative‑contentious appeal filed by Intersindical Canaria was dismissed.

The ruling issued by the Administrative Litigation Court rejects the union’s appeal and confirms that the Council’s actions were lawful, dismissing all the grounds of challenge raised. The judgment also orders the appellant to bear the legal costs.

The governing group welcomes this judicial pronouncement, noting that it reinforces the legal certainty of the procedures the Council has launched in the field of personnel and public employment.

The court’s decision validates, among other points, that the 2025 Public Employment Offer:

  • correctly identified the positions included,
  • respected the legal system of grades and sub‑grades,
  • distinguished between civil servant and contractual staff, as well as between free‑turn and internal promotion, and
  • was properly justified with the reports attached to the file.

The judgment also rejects the claim of a supposed lack of collective bargaining, stating that the Council demonstrated a willingness to negotiate, that the proposal was submitted to the General Negotiating Table, and that the union had the opportunity to present its arguments.

The Council recalls that this is not the first favourable court decision against challenges brought by Intersindical Canaria, and regrets that certain judicial actions are contributing to delays and obstacles in administrative procedures aimed at improving municipal organisation, strengthening public services, and meeting the institution’s staffing needs.

In this sense, the municipal government argues that the 2025 Public Employment Offer is not only a legal and necessary tool for human‑resource planning, but also an instrument to continue working on the stabilisation, promotion, and enhancement of professional opportunities for municipal staff.

These favourable rulings demonstrate that the Council is acting correctly and that attempts to halt municipal management do not benefit either workers or citizens.

Finally, the Puerto del Rosario City Council reaffirms its commitment to defending the general interest, improving public services, and promoting the public‑employment processes needed to ensure a more efficient, orderly administration that serves the town’s residents.
